Collection of Personal Data 

By booking a tour or using the services of Authentic Borneo Tour Sdn Bhd,  you consent to the collection, use, and processing of your personal data, including but not limited to your name, contact details, passport information, payment details, and any other information necessary to provide our travel services. 

 

Purpose of Use 

Your personal data will be used for purposes such as processing bookings, arranging travel services, communicating with you, complying with legal obligations, and improving our products and services. 

 

Disclosure of Data 

Authentic Borneo Tours Sdn Bhd, may share your personal data with third-party service providers (e.g., hotels, transportation companies) only to the extent necessary to fulfill your booking or comply with legal requirements. We will not sell, rent, or trade your personal data to any third party for marketing purposes without your consent. 

 

Data Security 

We implement reasonable security measures to protect your personal data from unauthorized access, disclosure, alteration, or destruction. However, no method of electronic transmission or storage is completely secure, and we cannot guarantee absolute data security. 

 

Customer Rights 

Under Malaysia’s Personal Data Protection Act 2010 (PDPA), you have the right to access, correct, or request deletion of your personal data, subject to applicable legal and contractual restrictions. Requests may be made by contacting us at the details provided in the “Contact Us” section of these Terms & Conditions. 

 

Retention of Data 

We will retain your personal data only for as long as necessary to fulfill the purposes for which it was collected and to comply with legal or regulatory requirements. 

 

Post-Tour Complaints 

Any complaints regarding services provided by Authentic Borneo Tour Sdn Bhd,  must be submitted in writing (by email or letter) within seven (7) days of the tour’s completion. Complaints received after this period may not be accepted, as it may be impossible to verify the details. 

 

All complaints must include: 

  • The customer’s full name, booking reference, and travel dates;
  • A detailed description of the issue; and
  • Supporting documents or evidence (such as photos, receipts, or witness statements) if available.

 

Authentic Borneo Tours Sdn Bhd will acknowledge receipt of the complaint and will make every effort to provide a written response within business days. 

 

Customers are encouraged to raise any issues during the tour with the guide or our local representative so that corrective measures can be taken immediately. Failure to do so may limit our ability to offer compensation or solutions. 

 

 Exclusions in Tour Cost 

Unless expressly stated in the itinerary or booking confirmation, the following items are not included in the tour price and are the responsibility of the customer: 

  • International or domestic airfares to/from the tour starting point (unless specified).
  • Visa fees, passport costs, and any immigration-related charges.
  • Travel insurance of any kind.
  • Personal expenses, including laundry, telephone calls, room service, minibar, or other incidental charges.
  • Meals and beverages not listed in the itinerary.
  • Optional tours, activities, or excursions not specifically included in the package.
  • Gratuities or tips for guides, drivers, porters, or hotel staff (unless stated otherwise).
  • Tourism taxes, conservation fees, or government-imposed charges payable directly to hotels, parks, or authorities unless explicitly included in the booking price.
  • Any other items or services not expressly mentioned as included in the booking confirmation or itinerary.

 

Tourism Tax & Government-Imposed Fees 

  • All travelers are responsible for paying any tourism taxes, conservation fees, or other government-imposed charges that may apply at hotels, resorts, national parks, or tourist attractions in Malaysia. 
  • These taxes or fees are set by the Malaysian Government or local authorities and may be subject to change without prior notice. 

Authentic Borneo Tours Sdn Bhd will inform customers of such charges whenever possible, but we shall not be held liable for any increase, new tax, or fee imposed after a booking is confirmed. 

Such charges are payable directly by the customer to the relevant hotel, government body, or service provider, unless specifically stated as included in the booking price. 

Example for Malaysia 

  • As of now, a Tourism Tax (TTx) of RM10 per room per night applies to foreign guests staying at registered hotels in Malaysia. (Rate subject to change by the Malaysian Government.)
